These Terms and Conditions apply to purchases from and dealings with New South Gallery. By purchasing an artwork or other item from us, you agree to these Terms and Conditions, unless otherwise agreed in writing.
1. About New South Gallery
New South Gallery is the commercial name of TIME4ART BV, a company incorporated under Belgian law.

2. Artworks and information
We take reasonable care to ensure that descriptions, dimensions, images, provenance and other information concerning artworks are accurate.
Images displayed on our website are for illustrative purposes. Colours, texture, scale and other visual characteristics may vary depending on photography, lighting and the device or screen used.
Where relevant, additional information concerning an artwork can be requested from the gallery before purchase.
3. Availability
All artworks are subject to availability.
Displaying an artwork on our website or communicating information about an artwork does not guarantee that it remains available for purchase.
New South Gallery reserves the right to withdraw an artwork from sale prior to the conclusion of a binding sale.
4. Prices
Unless otherwise stated, prices are quoted in euros and include applicable taxes where required.
Delivery, insurance, customs duties, import taxes and other additional costs are not included unless expressly stated or agreed.
Where additional charges apply, these will be communicated before the sale is concluded where required by applicable law.
5. Orders and sales
An enquiry concerning an artwork does not constitute a binding purchase.
A sale becomes binding when the purchase has been confirmed by New South Gallery and, where applicable, payment terms have been agreed.
New South Gallery reserves the right to refuse or cancel a transaction where reasonably necessary, including where an artwork is no longer available, a material pricing or description error has occurred, or legal or regulatory requirements prevent completion of the transaction.
6. Payment
Payment must be made using a payment method accepted by New South Gallery and within the period specified on the invoice or otherwise agreed in writing.
Unless otherwise agreed, artworks will not be released or dispatched until payment has been received in full.
7. Delivery and collection
Artworks may be collected from New South Gallery or delivered by arrangement.
Any estimated delivery date is indicative unless a specific delivery date has expressly been agreed.
Delivery, packing, transport and insurance arrangements and associated costs will be communicated or agreed with the purchaser as appropriate.
For sales to consumers, mandatory Belgian and European consumer protection rules concerning delivery and transfer of risk remain fully applicable. Belgian law generally requires delivery within 30 days unless another delivery time has been agreed, and where the gallery arranges transport the risk generally remains with the business until the consumer or their designated third party physically receives the goods.
8. Inspection upon receipt
Purchasers are requested to inspect artworks promptly upon collection or delivery and to notify New South Gallery as soon as reasonably possible of any visible damage or discrepancy.
Nothing in these Terms limits any mandatory statutory rights available to consumers.
9. Right of withdrawal
Where a consumer purchases an artwork entirely at a distance, including online or by other means of distance communication, the consumer may have a statutory right to withdraw from the purchase within 14 calendar days, subject to the conditions and exceptions provided by applicable Belgian and European consumer law.
This statutory right of withdrawal generally does not apply to purchases concluded in the physical gallery.
Certain statutory exceptions may also apply, including in relation to goods made to the consumer's specifications or clearly personalised.
Where a statutory right of withdrawal applies, New South Gallery will provide the information and procedure required by applicable law.
10. Authenticity and attribution
New South Gallery takes reasonable care in relation to the attribution and description of artworks offered for sale.
Where an artwork is accompanied by a certificate of authenticity, provenance documentation or other documentation, this will be provided or made available as appropriate.
Any attribution, date, provenance or other scholarly information is provided in good faith on the basis of information reasonably available to the gallery at the relevant time.
Nothing in this clause limits rights that cannot lawfully be excluded.
11. Copyright and intellectual property
The sale of an artwork transfers ownership of the physical artwork only.
Copyright and other intellectual property rights in an artwork remain with the artist or other relevant rights holder unless expressly transferred in writing.
Purchase of an artwork does not grant the purchaser any right to reproduce, publish, commercially exploit or otherwise use the artwork in a manner requiring permission from the relevant rights holder.
12. Website content
All content on the New South Gallery website, including text, images, photographs, graphics and branding, is protected by applicable intellectual property laws.
Content may not be reproduced, distributed or commercially used without prior permission from New South Gallery or the relevant rights holder.
13. Liability
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
Subject to mandatory legal rights, New South Gallery will not be liable for indirect or consequential loss arising from use of the website or a transaction with the gallery.
14. Privacy
Personal data is processed in accordance with our Privacy Policy.
15. Changes to these Terms
New South Gallery may amend these Terms and Conditions from time to time. The version applicable to a transaction will be the version in effect when that transaction is concluded, unless otherwise agreed.
16. Governing law
These Terms and Conditions and transactions with New South Gallery are governed by Belgian law, without prejudice to any mandatory consumer protection rights that may apply.
Any dispute will be submitted to the competent courts in accordance with applicable law.
